These Terms of Service ("Agreement") govern your access to and use of the beta version of ThriftSniper ("the App"), provided by ThriftSniper ("the Company"). By accessing or using the App, you agree to be bound by this Agreement.
1.1 Beta Release: The App is currently in beta testing, which means it may contain bugs, errors, or other issues that may affect its functionality, stability, and security.
1.2 User Responsibility: As a beta user, you understand and accept that you may encounter unforeseen problems while using the App. You agree to assume full responsibility for any consequences that may arise from your use of the beta version.
1.3 Feedback: The Company encourages you to provide feedback, suggestions, and bug reports regarding the App. However, the Company does not guarantee any response to, or implementation of, the feedback you provide.
2.1 Eligibility: You must be of legal age and have the necessary authority to enter into this Agreement. If you are accessing or using the App on behalf of an organization, you represent and warrant that you have the authority to bind the organization to this Agreement.
2.2 Limited License: The Company grants you a limited, non-exclusive, non-transferable, revocable license to use the App solely for the purpose of testing and providing feedback during the beta testing phase.
2.3 Prohibited Conduct: You agree not to:
(a) Use the App in any manner that violates applicable laws, regulations, or third-party rights; (b) Modify, adapt, reverse engineer, decompile, or disassemble the App, except to the extent permitted by applicable law; (c) Interfere with or disrupt the App or its servers, networks, or infrastructure; (d) Attempt to gain unauthorized access to the App, other user accounts, or any related systems or networks; (e) Use the App for any illegal, harmful, or unethical purposes; or (f) Violate any other terms or guidelines provided by the Company in relation to the App.
3.1 Disclaimer of Warranties: The App is provided on an "as-is" and "as available" basis. The Company disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
3.2 Limitation of Liability: To the maximum extent permitted by applicable law, the Company and its officers, directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use or inability to use the App, including but not limited to damages for loss of profits, data, or other intangible losses.
You agree to indemnify and hold the Company and its officers, directors, employees, agents, and affiliates harmless from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your use of the App, your violation of this Agreement, or your violation of any rights of third parties.
The Company reserves the right to terminate this Agreement and your access to the App at any time, without notice or liability, for any reason or no reason, including but not limited to a breach of this Agreement.
6.1 Entire Agreement: This Agreement constitutes the entire agreement between you and the Company regarding the subject matter herein and supersedes all prior or contemporaneous understandings.
6.2 Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the Company's jurisdiction. Any legal action or proceeding arising out of or related to this Agreement shall be brought exclusively in the courts of the Company's jurisdiction.
